TERMS AND CONDITIONS OF SALE

ARTICLE 1: SCOPE

These terms and conditions of sale apply to all sales made through the website https://hera-design.co/.

ARTICLE 2: ORDERS

Automatic recording systems are considered valid proof of the nature and content of the order. Hera Design® confirms acceptance of the order to the customer at the email address provided.

The sale is concluded once Hera Design® has validated payment of the order, i.e. the date payment is validated for orders paid online by card, or the date payment is received for orders paid by cheque.

Hera Design® reserves the right, in any event, to refuse or cancel any order from a customer with whom there is an outstanding dispute relating to payment of a previous order.

ARTICLE 3: AVAILABILITY OF ITEMS

Our offers and their prices are valid for as long as they remain visible on the site. The availability shown when the customer views the site depends on stock levels at Hera Design® and, of course, at our suppliers.

To build our showcase and sales catalogue, we work with databases enriched from information provided by our suppliers. As this database includes a large number of items, not all of them are held in our own stock, and our offer is therefore subject to availability from suppliers.

Only the permanent discontinuation of an item by our suppliers will result in its removal from our sales offer. In other cases, a new order may still be possible after a certain delay.

When an ordered product is unavailable, the customer is informed by email or, in the case of an order containing several items, on the invoice for the items shipped.

Order delivery deadline: when the order is placed, and on the order acknowledgement, customers are given a delivery timeframe. This is calculated by adding the longest product availability time to the transit time of the delivery method selected by the customer.

Between placing the order and its dispatch, the customer may cancel their order.

Special cases:

Pre-order items: forthcoming items may be offered for pre-order on the site https://hera-design.co/. This reservation is made with an indicative release date announced by the supplier or publisher when the reservation phase opens. This release date may be changed at any time by the supplier or publisher, who is solely responsible for marketing their product.

In all cases, Hera Design® endeavours, from the final release date, to ship items to customers who reserved them, subject to the stock provided for the release day.

ARTICLE 4: PRICES

Prices shown are deemed net, excluding shipping costs. This price includes the price of the products, and handling, packaging and storage costs.

Prices may be changed at any time without notice, it being understood that items will be invoiced on the basis in force when the order is registered.

All orders are invoiced and payable in the applicable currency. Any customs duties or local taxes remain the responsibility of the recipient.

ARTICLE 5: SHIPPING COSTS

Shipping costs include a contribution towards preparation, packaging and postage costs.

Please try to group all your items into a single order. We are unable to merge two separate orders, and shipping costs will be charged for each of them.

ARTICLE 6: PAYMENT

Several payment methods are available to you, offering maximum security guarantees.

You may pay:

• By card (Visa, Eurocard/Mastercard), either directly on the site, via the payment form provided during checkout, with secure entry via SSL encryption.

• By PayPal.

Various payment methods are available, and you may be eligible for card payment facilities depending on the options offered at the time of order.

Payment is processed via our partners' secure banking servers of your choice. This means that no banking information relating to you passes through the site https://hera-design.co/.

Card payment is therefore secure; your order will be recorded and validated as soon as payment is accepted by the bank.

ARTICLE 7: DELIVERY

We deliver to your home or to a collection point.

The delivery time includes the time taken to prepare the parcel plus transit time. Hera Design® delivers to the geographic areas indicated on the site.

The buyer is notified by email of the various stages of tracking their order, in particular its preparation and dispatch.

The delivery time includes preparation time and delivery by our carrier. The delivery time announced is communicated to the customer when the order is placed and may vary depending on destination, the chosen delivery method and any transport-related contingencies.

Timeframes communicated by the carrier cannot bind Hera Design® beyond its legally applicable obligations.

ARTICLE 8: WARRANTY - RETURNS - REFUNDS - RIGHT OF WITHDRAWAL

Items supplied by https://hera-design.co/ are new and benefit from applicable legal warranties. They are identical to those offered in traditional retail and come from listed suppliers.

Should an item prove defective or non-conforming, the buyer must contact Hera Design® as soon as possible to request, as appropriate, a repair, replacement, price reduction or refund in accordance with applicable legal provisions.

The customer must return the items concerned in a condition allowing them to be resold, together with, where necessary, their accessories, instructions and documentation.

In such a case, the buyer must send a precise description of the problem, along with photographs if possible, to contact@hera-design.co.

Right of withdrawal:

In accordance with applicable legal provisions, the consumer has, except where exceptions provided by law apply, a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal.

Where the right of withdrawal is validly exercised, Hera Design® refunds amounts paid in accordance with applicable legal provisions.

Direct return costs may remain the customer's responsibility where the regulations provide for this and the customer has been informed in advance.

The refund is made within the timeframes provided for by the applicable regulations.

No cash-on-delivery parcels will be accepted.

ARTICLE 9: TRANSFER OF OWNERSHIP - TRANSFER OF RISK

Ownership of the products is transferred to the buyer only after full payment of the price, regardless of the delivery date of the said products.

The transfer of risk of loss and damage to the products takes place in accordance with applicable legal provisions, in particular at the time the consumer, or a third party designated by them other than the carrier proposed by Hera Design®, physically takes possession of the products.

ARTICLE 10: PROTECTION OF YOUR PERSONAL DATA

Hera Design® is the producer and owner of all or part of the databases making up this site.

By accessing this site, the customer acknowledges that the data comprising it is legally protected and specifically undertakes not to extract, reuse, store, reproduce, represent or retain, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing on the site they access.

Any personal data collected is processed in accordance with applicable data protection regulations and the privacy policy available on the site.

ARTICLE 11: LIABILITY

Product descriptions in the databases of https://hera-design.co/ were entered based on information provided by suppliers, manufacturers or publishers.

Hera Design® strives to provide information that is as accurate as possible but cannot be held liable for errors or omissions arising from information provided by suppliers or manufacturers.

Hera Design® is not liable for the content of the works or products offered and cannot be held liable in this respect to the buyer.

Hera Design®'s liability cannot be invoked in the event of force majeure or circumstances beyond its control, under the conditions provided for by law.

The products offered comply with applicable French and European regulations. Hera Design® accepts no liability if the item delivered does not comply with the specific legislation of the destination country where such non-compliance results from particular local rules of which Hera Design® could not reasonably have been aware.

Hera Design® is not responsible for the content of sites to which hyperlinks may lead from its own site.

ARTICLE 12: APPLICABLE LAW

All clauses contained in these terms and conditions of sale, as well as all purchase and sale transactions covered by them, are governed by French law.

ARTICLE 13: BUYER'S ACCEPTANCE

These terms and conditions of sale, together with the prices, are expressly agreed to and accepted by the buyer, who declares and acknowledges having read them before placing any order.

Validation of the order by the customer implies full and complete acceptance of these terms and conditions of sale.

These terms and conditions of sale may be amended at any time by Hera Design®. The applicable terms are those in force on the date of the order.
